Please read these terms and conditions thoroughly before commissioning, as it covers all bases on my guidelines and policies. Upon requesting, trading with or commissioning me, you confirm that you've read and agree to follow this TOS.Failure to follow my TOS will result in blacklisting. I will typically contact you first depending on the offence.Any offences where you will be contacted instead of just being blacklisted will be marked with '⚠︎' and serious offences where you will not be contacted and immediately blacklisted will be marked with '⚠︎⚠︎' .If I have no way of contacting you, or you don't respond whilst being visibly active, you will be blacklisted immediately.

1. General & Commission Terms

I retain the right to update these terms when and if I please, but please note that if they have changed post-transaction, only the terms that were available at the time of the transaction will be applicable to you.

1.1 Blacklisted themes

✦ I will not draw any form of art portraying zoophilia, pedophilia, racism, xenophobia, ableism, LGBTQ+ phobia, nazi or MAGA themes or draw for anyone that has been reported as aligning with these viewpoints.

1.2 References

✦ Please send clear references, or reference images of your chosen subject. Please ensure that these are not shaded or have a clear and viewable colour palette.✦ Any character without a design will be counted as a design commission (such as sending a moodboard).

1.3 Cancellations

✦ If you wish to request a refund, please contact me directly instead of filing a dispute. You can request a full refund up until the colour stage. If you have requested a refund before the colour stage, you acknowledge that you do not have the right to use any prior artworks sent to you.If you request a refund past the colour stage, you will receive the amount -the cost of a sketch piece. You acknowledge that you have the right to use the sketch, but not the coloured WIP.✦ If you've purchased an unshaded commission and you request a refund past the colour stage (for example, for a coloured icon) you will not receive one since the piece is finished.For unshaded/flat coloured pieces, you can request a full refund before the colour stage. When doing this, you acknowledge that you do not have the right to use any prior artworks sent to you unless a partial refund, with the price of a sketch deducted, is discussed.✦⚠︎ Disrespectful behaviour will not be tolerated and may result in a cancellation and refund. You will receive a partial refund if this behaviour occurs post-sketch phase.✦ If my queue is empty and you receive no updates, notices or no progress from me for three months, you are entitled to a full refund. This does not cover larger pieces, such as several fullbodies, animations or scenes which may take longer.This does not apply to trades which does not involve a monetary transaction.✦ I have the right to refuse commissions.✦ I have the right to cancel and refund commissions.

1.4 Notes

✦ I prefer to personally attach images to characters on Toyhou.se, so please send me a link of your chosen character if they're on there. This is to ensure that I'm credited correctly, and also so that I can see first-hand if a file I've attached is too large for Toyhou.se to handle, and then rectify it.This isn't necessary however, and you won't be blacklisted if you don't send a link or aren't comfortable with it.

2. Work process

2.1 Progress

✦ The stages of my work progress as follows:

Work In Progress (WIP) images will be sent once each stage is finished. The finished piece will be sent once completed.✦ No further changes can be made after the first three stages have passed, otherwise a fee will be added. Please inform me of any errors before I begin shading.

2.2 What to expect

✦ Larger commissions (such as a shaded fullbody, or difficult animations) can take up to a couple of weeks or more.✦ Between each owed art piece, I tend to work on a personal piece to keep my motivation flowing. If you see a personal piece being worked on in my queue, it's typically because I've just finished an owed art piece.✦ You can follow my progress on my public Art Queue on Trello.✦ Many factors may interrupt or hinder my work schedule, such as my health, work or home life. If any of the above occurs, I will notify the client asap. If I don't notify you, see line 3 in 1.4 Cancellations.

3. Trade terms

3.1 Process

✦ During character trades, I will send a watermarked version of the finished piece. I will not send the unwatermarked version until the character has been rightfully transferred to me. This is always discussed upon trading to avoid any confusion.
You cannot use the watermarked piece, please contact me if you'd like an officially watermarked piece (with a less-obstructive watermark).✦ Regarding mutual art trades, I prefer to finish my side first due to motivational concerns. My motivation often fluctuates, but understanding that I will receive a piece in return motivates me to continue.

3.2 Cancellations

✦ When cancelling a trade you are not permitted to use, download or upload any artworks I may have sent to you.✦⚠︎ Please contact me directly if you'd like to cancel our trade. Do not transfer the character to another user without informing me.✦ When cancelling a trade I have full rights to repurpose the artwork I've drawn for myself or others.

4. Copyright & Usage policy

4.1 Usage policy

✦ I retain the right to use commissioned, traded or gift pieces to advertise myself or post where I'd like. I will not use works this way if it is clarified beforehand by the client and agreed upon.✦ When it comes to art pieces of fandom characters, you're free to use them as your PFP or Discord banner, as long as you credit me somewhere on your profile. This goes for non-commissioned works only, if someone commissions me for a fandom character, you are not to use their artwork for your own profile. This does not include reposting, please do not repost my fandom works even with credit.✦⚠︎ Do not use or upload WIPs for any reason unless I've been asked and have given you explicit permission to use them. This does not include situations where you may send my WIP pieces to another user to view the progress of an art piece as it's being made, that's perfectly fine.✦⚠︎ If I've decided to redraw a piece or draw something different for you instead, you are not permitted to use or upload the previous unfinished piece in any way.✦⚠︎ Do not copy, trace or heavily reference my work unless permission is explicitly given. Personal usage of these artworks to help yourself grow as an artist is perfectly fine, but please do not post these for public consumption, or claim them as wholly your own art in any way, keep them private.✦⚠︎⚠︎ Do not use my artwork for NFT's, cryptocurrency or to train AI and do not use AI to make additions/change my artwork in any way.✦⚠︎⚠︎ You do not have the right to use any of my work that doesn't belong to you. This includes designs and art pieces of either my characters or of other people's characters.✦ You are free to enlarge or minimize my artwork or make additions (for example if your character's design has changed) if needed. All I ask is that you leave a note indicating that you have edited it. (Editing my artwork does not and should not attribute any extra worth).
Of course this does not apply to art pieces you don't own.
If you ever struggle, you're free to contact me and, if I can, I'll do it for you!✦⚠︎⚠︎ Do not edit my artwork to include any of the themes described in 1.1 Blacklisted themes.

4.2 Commission terms

✦⚠︎ Do not use my artworks or designs for commercial usage without consulting me, such as using my designs as a branding mascot for a company, or otherwise. Commercial uses require a fee upon commissioning. A commercial use fee does not apply to smaller artist, Vtubers nor PNGtubers, but only for large companies/businesses planning to use my design solely as a mascot on logos, watermarks and advertising.

4.3 Design terms

✦ You are free to make any changes you feel necessary to a design of mine that you own. It's not mandatory to notify me, but I would love to see your finished work!
✦⚠︎ All of my designs have a two week cool down period before they can be sold again. Please do not sell them under a two week timeframe.✦⚠︎ You can remove designs from Toyhou.se, all I ask is that you notify me. If you wish to permanently delete a design and not store them elsewhere, please return them to the previous owner, or transfer them to me.✦⚠︎ I prefer that my designs aren't sold outside of Toyhou.se without prior notification.✦⚠︎⚠︎ Please follow the sales permissions attached to your character.✦⚠︎ Please do not re-upload designs on Toyhou.se to bypass sales permissions.✦⚠︎ ⚠︎ Please do not trade, sell or gift any of my designs to users on my blacklist.✦ You can put my designs on authorize only. I appreciate authorization, but it's not necessary.✦ Holds can go up to five weeks (a month and a week), but no longer.✦ Please do not re-upload a design for co-owning, please keep it on one user's account or on a separate account that both of you have access to. Re-uploading a design of mine for co-owning purposes means that the rules I put in place will not be present on the character's profile.✦ When crediting me for a design on Toyhou.se, please do not tag me as the 'designer' as this can easily be removed. Please tag me as the creator.✦ In no scenario will I ever 'retract' a design I've traded/sold or gifted, I will only reupload them if my credits are removed. In the case that my credits are removed, I will re-upload the character with only my original art piece attached and the correct credit so that it appears in my designs gallery.The only other occasion where I may re-upload and use a design is if it has been deleted entirely, not just from Toyhou.se.

4.4 Credits

As of writing this, it's been several days and they still have not communicated.

TDLR: Grooming, real life theft, sharing private messages, character theft, spreading misinformation, unauthorised log-ins, falsifying receipts.

✦ This user has not only contributed to harmful misinformation made about me and my partner, but has been involved in the makings of burner accounts to create drama, has stolen hard drives and diary pages with my partner's passwords to socials on them and, not only allegedly owns these, but has used them to log into his socials, such as Discord and Deviant art.They began sharing me and my partner's early Discord messages to the user stated above them in the blacklist, which held a lot of personal information of my ongoing situation with abuse, which I shared in private to my now partner. They also deleted DeviantArt submissions, including images of my partner's late dog and has not yet given access back. This user also stole two of my close friend's designs and reposted them to toyhou.se without credit, then gave them away to the user above them on the blacklist. This user also made several alternate accounts to contact and stalk me and my partner's Instagram and Toyhou.se accounts.This user is a renowned abuser, and with the user above them in the blacklist, crafted clearly falsified receipts to spread harmful misinformation about my partner. This user has also communicated romantically and sexually with a minor whilst over the age of 18 (20+).

TDLR: Suicide baiting, lying on the internet

✦ This user posted on all of their socials posing as their friend 'Simon', claiming that they, Liam, had died.This was posted on their Instagram, Facebook and Toyhou.se.
Not only did the user claim they were dead, but then backtracked and claimed they were in a coma to their Facebook community. When I pressed them about this, they told me that they 'lied because there are nosy old ladies and family on there and his family think suicide is bad'.Suddenly, as of 17/01/26, they're claiming they're alive and that they are recovering from intoxication, after their 'friend Simon', on the same account, claimed that they were 100% dead.They've since removed all of their other accounts apart from Toyhou.se, blocked me on Toyhou.se, and then added me to their blacklist (pre-being 'alive' again).
In their blacklist entry regarding me, they state that I am a stalker, when all of these accounts were linked to their Toyhou.se, and that I lied about their 'would-be-fiancee'. This entry is clearly written by Liam, still pretending to be his 'friend' named 'Simon', and Liam has very obviously forgotten to change this post-'being alive again'.I have added this entry due to their attempts to paint me as the villain.UPDATE:Liam has since removed the blacklist listing of me and deleted all of his characters, despite the Terms of Services of all of the designers, including explaining that he will delete his account, titled 'CharcatersUpForGrabs'. Upon being confronted Liam lied to both me and those around him.I have been sent evidence of his vile behaviour towards others, including harassment and verbal abuse towards his now ex-partner and their friends.Please contact me for evidence if needed, I'm absolutely willing to oblige.

✦ This user has not only threatened me, but has also been spreading harmful misinformation about me and my partner. Whilst any mention of my name has been removed, my partner is still being routinely slandered.They and salty.dipshit were in close relation to one another and this user was given me and my partner's private Discord conversations by salty.dipshit. With the user below them in the blacklist, they crafted clearly falsified receipts to spread harmful misinformation about my partner.

TDLR: Zoophilia, pedophilia, justifying sexual assault, victim blaming, sending death threats and mocking tragic events.

✦ An old bulletin of theirs on their main profile, goobering, linked on their alternate Toyhou.se account, bandu, was discovered which included an apology for zoophilia, harassing a victim their partner sexually assaulted, claiming that what their ex said isn't "that fucking intense" and that "there's no way people are that sensitive", and giving death threats. In my personal opinion, after reading the text, the situation was not given the respect it deserved, the tone they delivered being an extremely unserious one.This user also made a character that's romantically involved with an adult five years their elder as a minor. They stated that the information was just "outdated", but this didn't align with the rest of the information the character had readily available on their profile.To add to this, the user made a bulletin stating "happy 9/11", further mocking the situation by stating that there'd be a roleplay about it.
